Wisconsin Restraining Order Laws
A restraining order, also known as an injunction, is a court order signed by a judge ordering an individual who has committed domestic abuse or harassment to stop his or her abusive actions or face legal consequences. A domestic abuse restraining order may also order that the abuser stay away from your residence and may prohibit him or her from contacting you in any way, except through an attorney or a law enforcement officer. The abuser may be ordered to turn over any firearms and be prevented from owning them. You may also receive any other relief that the court decides is necessary for your protection.
Types of Wisconsin Restraining Orders
Under Wisconsin law, there are four types of restraining orders which may be issued for the protection of an individual or child. They are domestic abuse, harassment, child abuse, and individual at risk restraining orders. The basis for an individual at risk restraining order may be physical, emotional, or sexual abuse, financial exploitation, stalking, neglect, unreasonable confinement or restraint, treatment without consent, and mistreatment of an animal.
How to File for a Restraining Order in Wisconsin
Victims of domestic abuse or harassment can request a temporary restraining order (TRO) against the alleged abuser. Granting a TRO is done ex parte, which means without a hearing. If the court or judge grants the TRO, the order is valid until the injunction hearing, which is generally within 14 days.
At the injunction hearing, the victim can ask the court for a final order of protection or injunction. Both sides have the opportunity to present their evidence. If an injunction is granted, the order lasts up to four years for domestic abuse, harassment, and individuals at risk, or up to two years for child abuse.
